competition between each target platform of their latest Battlefield
expansion — Bad Company 2: Vietnam. Players were required to complete a
large number of 'team actions' in game, in order to unlock a hidden,
remastered version of the Operation Hastings map from the original
Battlefield: Vietnam. [1]PC gamers have completed the task, whereas
gamers on both console platforms are only about halfway there."

Meshach writes "A report out of FOX News (I know, I know) says that
[0]there are far fewer unique species of plants than previously thought.
The report states that only about a third of named species are actually
unique. The rest have been 'discovered' multiple times, often by separate
scientists."

Relayman writes "Joe Mailer wanted to download an iTunes movie recently
and his Apple TV told him it would take two hours. When he switched his
DNS resolver settings, the [0]download time dropped to less than 20
seconds. Apparently, iTunes content is served by Akamai which uses
geolocation based on the IP address of the DNS request to determine which
server should provide his content. When you use Google or Open DNS to
resolve the Apple domain name, all the requests to Akamai appear to be
coming from the same location and they're all directed to the same server
pool, overloading that pool and causing the slow downloads. The solution:
Be wary of using Google or Open DNS when downloading iTunes files or
similar large files. Use your own ISP's DNS servers instead or run your
own resolving DNS server."

wiredmikey writes "The FBI reported this week that Qiang 'Michael' Bi, of
Powell, Ohio was [0]sentenced to 30 months in prison for selling more
than 35,000 illegally copied computer games over the Internet between
2005 and 2009. According to a statement of facts read during Bi's plea
hearing, agents executed a search warrant at Bi's house and found
multiple CD duplicators and more than 1,000 printed counterfeit CDs. Some
of the CDs were still in the duplicator. During their investigation,
agents learned that Bi would buy a single copy of a game, illegally
duplicate it and sell the copies on eBay.com and Amazon.com. He also set
up a website for customers to download the games they bought. Bi accepted
payment through eBay and PayPal accounts in his name and in others'
names."

and shuttered 60,000 websites in an ongoing anti-pornography crackdown.
"Wang Chen, director of the Information Office of the State Council, said
at a news conference that some 350 million pieces of pornographic and
indecent internet content were eliminated, according to the Xinhua
report. The government launched a special campaign a year ago to rid the
internet of pornographic and vulgar content, Xinhua reported. Overall,
the campaign included 2,197 criminal cases involving 4,965 people who
violated Chinese law by disseminating pornography via the internet or
mobile phones, the news agency said. Of those, 58 people received prison
sentences exceeding five years."

application for [2]Propagating Promotional Information on a Social
Network, which the search giant explains 'generally relates to creating
and providing promotional information (e.g., advertising, public service
announcements, etc.) to users of a social network (e.g., FACEBOOK,
MYSPACE, ORKUT, LINKEDIN, TWITTER, etc.).' By doing so 'across multiple
social networks,' Google adds, 'the impact of the other promotional
information may exponentially expand to other users of a social network."

Techmeology writes "GSM eavesdropping has been demonstrated at the Chaos
Computer Club Congress in Berlin [0]using a €10 Motorola phone and open
source GSM firmware. Karsten Nohl and Sylvain Munaut replaced the
firmware on the phone, enabling them to process all the data it received.
They used already available rainbow tables to decrypt data being sent to
and from other mobile phones. They have no plans to release the hack
publicly, however they expect others to successfully attempt the hack.
Mr. Nohl said the objective was to raise awareness of GSM's insecurity."

and similar websites based on user-generated content will be considered
TV stations (Google translation of [1]Italian original) in Italian law,
and will be subject to the same obligations. Among these, a small tax
(500 €), the obligation to publish corrections within 48 hours upon
request of people who consider themselves slandered by published content,
and the obligation not to broadcast content inappropriate for children in
certain time slots. The main change, though, is that YouTube and similar
sites will be legally responsible of all published content as long as
they have any form (even if automated) of editorial control. The main
reason for this is probably that it will force YouTube to assume
editorial responsibility for all published content, which facilitates the
[2]ongoing € 500M lawsuit of Italian prime minister Silvio Berlusconi
against YouTube because of content copyrighted by Berlusconi's TV
networks that some users uploaded on YouTube. Berlusconi's Spanish TV
station, TeleCinco, was [3]previously defeated in court on the grounds
that YouTube is not a content provider."

CBC reports on sad news for Star Wars fans: "Grant McCune, a special
effects artist who earned an Oscar for his work on the 1977 film Star
Wars, has died. He was 67. [0]McCune died Monday at his home in Hidden
Hills, Calif., of pancreatic cancer. McCune created scenes with
miniatures, models and special effects for dozens of movies, including
Spaceballs, Ghostbusters II and 2008's Rambo. He began in special effects
in 1975 when he and friend Bill Shourt were hired to make a giant white
shark model for Steven Spielberg's Jaws. They got no credit for the film,
but McCune caught the eye of the film community and he became chief model
maker for Star Wars, where he created R2-D2 and many of the creatures
that populate the film."

[Drug and Device Law] A Happy New Year To Our Readers

On this last day of the 2010, we'd like to wish our readers a happy, healthy, and prosperous new year.  To all our defense side readers, we further wish you success in winning your cases.


Now, because we are the Drug and Device Law Blog, we can't just leave our post just at that.  Two things:

Yesterday the Montana Supreme Court, reaffirmed the learned intermediary rule, although holding that the duty to warn extended to all of the medical personnel - including nurses - who treated the plaintiff.  Stevens v. Novartis Pharmaceuticals Corp., DA 10-0029  slip op., at 30 (Mont. Dec. 30, 2010) ("[w]e concur with authorities who consider the learned intermediary to be the healthcare professional actually responsible for making decisions related to the patient's care").   It did so, however, in the context of ruling for the plaintiff on limiting the rule to prescribing physicians.

And aside from generally reaffirming the rule, Stevens is a not anything to be happy about this new year.  For one thing, it adopts cross-jurisdictional class action tolling, contrary to all but a couple of states.   That's pretty bad - don't let anybody tell you the Montana Supreme Court is "conservative" on tort issues.  It isn't.

Point #2.  Full-blown chaos has developed in the Pennsylvania federal district courts on the Azzarello/Restatement Third issue - demonstrating, we think, precisely why stare decisis is a good idea.

Since we wrote our last post on the subject back in March, three more cases have been decided.  Two of them, Covell v. Bell Sports, Inc., 2010 WL 4783043 (E.D. Pa. Sept. 8, 2010), and Hoffman v. Paper Converting Machine Co., 694 F. Supp.2d 359 (E.D. Pa. 2010), did the right thing and followed applicable Third Circuit precedent - Covell on the admissibility of industry and governmental standards, 2010 WL 4783043, at *4-7, and Hoffman on feasible alternative designs. 694 F. Supp.2d at 365-66.

Then along comes this stinkeroo, Sweitzer v. Oxmaster, Inc., 2010 WL 5257226 (E.D. Pa. Dec. 23, 2010), where the court admits it's result "may appear to be at odds with certain Third Circuit Court of Appeals case law" - that is to say Berrier v. Simplicity Manufacturing, Inc., 563 F.3d 38, 53 (3d Cir. 2009), where the Third Circuit, after an exhaustive review of Pennsylvania law, predicted that Pennsylvania would adopt the Third Restatement of Torts.

Sweitzer decides to ignore Berrier based upon such profundities as "that result has not materialized" and it has "not found any Supreme Court or Superior Court post-Bugosh decision that has applied the Third Restatement."  Well, duh.  It hasn't materialized - that's why we refer to Erie predictions as "predictions."  And sure, there isn't any Pennsylvania state precedent - we're still waiting on the Supreme Court, and the Superior Court, as a lower court, is bound - just as Sweitzer is supposed to be bound by Berrier.

But Sweitzer ignores the Third Circuit essentially because it's uncomfortable with what the Third Circuit did in Berrier.  It's decision to exclude industry standards evidence, 2010 WL 5257226, at *10-11, puts it in direct conflict with the earlier Covell decision.  Thus, we have chaos.  Despite an on-point Third Circuit decision, we have the spectacle of the Pennslyvania district courts running around like chickens with their heads cut off deciding the same issues willy-nilly based upon personal preferences without regard for binding precedent.

It's obvious from the snide remark in Sweitzer - "Without addressing the question of whether or not Berrier amounts to excessive prognostication under Erie," 2010 WL 5257226, at *4 - that this particular judge doesn't think much of Berrier.  Whether or not Berrier was right, it's binding.  Rather than descending into decisional chaos, however, the jurisprudential thing to do would be to certify the issue for interlocutory appeal.  Then the Third Circuit could kick the issue over to the Pennsylvania Supreme Court (like it tried to do in Berrier), and maybe this time the right court could decide once and for all what Pennsylvania law is.


Albus Dumbledore should have been a federal judge.  Sometimes courts have to choose what is right over what is easy.

So Happy New Year to all - and may the new year be an improvement on the old.

[DK GreenRoots] marveling at things small and large - a visual trip through the year

this is sort of a personal summary of the year for me, but I think it
speaks to the larger questions we all have on how to be activists
without despairing and constantly feeling frustrated. Looking at
climate change and the many environmental issues through a creative
and somewhat spiritual lens helps me to stay centered and focused. And
I'm thinking this is the kind of approach Bill McKibben may have in
mind when he says we need to be creative and imaginative in bringing
about change.

An anonymous reader writes "The Seoul Metropolitan Government just rolled
out the [0]world's first commercial all-electric bus service. The buses
were designed to be as efficient as possible — each bus can run up to
about 52 miles on a single charge and they have a maximum speed of about
62 miles per hour. The vehicles' lithium-ion battery packs can be fully
charged in less than 30 minutes and they also feature regenerative
braking systems that reuse energy from brakes when running downhill."

pirated copies of popular video games, Call of Duty: Black Ops has won
the dubious honor of being [0]the most pirated game of 2010. The PC
version of the game was torrented roughly 4,270,000 times, and the Xbox
360 version was downloaded an additional 930,000 times. (The most pirated
Wii game was Super Mario Galaxy 2, and Dante's Inferno somehow managed to

magic word 'rape' in the title. Just how far is this going to be allowed

Orome1 writes "In October Commtouch reported an 18% drop in global spam
levels (comparing September and October). This was largely attributed to
the closure of Spamit around the end of September. Spamit is the
organization allegedly behind a fair percentage of the worlds pharmacy
spam. Analysis of the spam trends to date reveals a [0]further drop in
the amounts of spam sent during Q4 2010. December's daily average was
around 30% less than September's. The average spam level for the quarter
was 83% down from 88% in Q3 2010. The beginning of December saw a low of
nearly 74%."

sophisticated Trojan targeting Android devices, who "say the mobile
malware is 'The most sophisticated Android malware we've seen to date,
Geinimi is also the first Android malware in the wild that displays
botnet-like capabilities. Once the malware is installed on a user's
phone, it has the potential to receive commands from a remote server that
allow the owner of that server to control the phone.' What makes the
Trojan different from most 'standard' mobile malware is that Geinimi is
being 'grafted' onto repackaged versions of legitimate applications,
