A privacy activist has filed a lawsuit targeting eight corporate users of
Quantcast's "zombie" Flash cookies, in addition to Quantcast itself. The
suit alleges that MTV, ESPN, MySpace, Hulu, ABC, Scribd, and others used
Quancast's Flash-based cookies to [0]recreate browser tracking cookies
that users had taken the trouble to delete. "At issue is technology from
Quantcast, also targeted in the lawsuit. Quantcast created Flash cookies
that track users across the web, and used them to re-create traditional
browser cookies that users deleted from their computers. These 'zombie'
cookies came to light last year, after researchers at UC Berkeley
documented deleted browser cookies returning to life. Quantcast quickly
fixed the issue, calling it an unintended consequence of trying to
measure web traffic accurately. ... The [1]lawsuit (PDF)... asks the
court to find that the practice violated eavesdropping and hacking laws,
and that the practice of secretly tracking users also violated state and
federal fair trade laws. The lawsuit alleges a 'pattern of covert online
surveillance' and seeks status as a class action lawsuit."

California, San Diego have broken the 'terabyte barrier' — and a world
record — when they [0]sorted more than a trillion bytes of data in 60
seconds. During this 2010 'Sort Benchmark' competition, a sort of 'World
Cup of data sorting,' the UCSD team also tied a world record for fastest
data sorting rate, sifting through one trillion data records in 172
minutes — and did so using just a quarter of the computing resources of
the other record holder."

RedEaredSlider writes "Rambus, a designer of semiconductor chips, won a
long-running [0]patent battle with NVIDIA, but that dispute is [1]not the
only one the company is involved in — and the upcoming decisions could
mean millions in additional revenue. Besides the NVIDIA decision, Rambus
is involved in a suit with Hynix Semiconductor that will be heard in
October. In that case, Hynix had originally sued Rambus in 2000, but
Rambus counter-sued. Hynix lost, and appealed. The parties will appear
before the US Court of Appeals for the Federal Circuit in October. A
judgment in Rambus's favor would be worth at least $397 million,
according to the company's general counsel, Tom Lavelle."

[1]have been following for [2]years. (As usual, use NoScript to avoid the
incredibly annoying timed begging popup on Gizmag's site.) Here is
[3]Toshiba's SCiB site. The battery's specs claim 6,000+
charge/deep-discharge cycles with minor capacity loss, safe rapid
charging to 90% in 5 minutes, and enhanced safety regarding overheating
or shorting out. It could make its way into electric vehicles before
long.

Danny Sullivan's hard-hitting piece at Search Engine Land calls on Google
to quit being evil in one particular way: [0]collaborating with sleazy
websites that jump on Google Trends to grab advertising revenue, as
Google itself rakes it in. "Google's CEO Eric Schmidt has quite famously
been on record many times talking about how the Web is full of garbage.
It's a cesspool out there, he's said. Today, a short fast look at how his
own company pollutes the Web. ... That [example of an off-topic,
trend-following] page isn't adding any value to the web. If it didn't
exist, we wouldn't be the less savvy... But thanks to Google Trends,
we've got a big red flag up in front of publishers that wish to pollute
Google's results with this type of garbage. ... On the one hand, I love
Google Trends. It's fun seeing what the top terms are that are sparking
interest... On the other hand, it's clear how much [garbage] Google has
caused to be generated, simply by publishing the trends. But that garbage
wouldn't happen, if it didn't know it was going to be rewarded. It is,
both with traffic from Google and from revenue from Google for those
carrying its ads."

preferences. From 2004-2008, the most commonly colored vehicle stolen was
black. This may be because black vehicles look more luxurious. Following
close behind black were gray/silver automobiles. Of the 109 pink cars in
the study, [0]not one was stolen. A bright and uncommon color, like pink,
may be as effective deterrent as an expensive security system. Ben
Vollaard, who conducted the research, wrote, 'If the aversion to driving
a car in an offbeat color is not too high – or if someone actually enjoys
it – then buying deterrence through an uncommon car color may be at least
as good a deal as buying deterrence through an expensive car security
device.'"

site. The 2.8GB torrent was compiled by hacker Ron Bowes of Skull
Security, who created a web crawler program that harvested data on users
contained in Facebook's open access directory, which lists all users who
haven't bothered to change their privacy settings to make their pages
unavailable to search engines."

Students in one New Jersey school district will no longer be able to
squeak by in class after the Morris County School Board approved
[0]dropping the D grade. Beginning in the fall students who don't get a C
or higher will get an F on their report card. "I'm tired of kids coming
to school and not learning and getting credit for it," said
Superintendent Larrie Reynolds in a Daily Record report.

An anonymous reader writes "In the past, I've seen my pictures used by
big commercial companies despite the Creative Commons license that
clearly limits them to non-commercial use. I just let it slide because a
friend who's a lawyer says that all I can do is sue. They've ignored
emails and comments. Today, I saw two other examples that show this is
pretty rampant. These big commercial corporations are some of the most
tech savvy publications around, but they [0]just grabbed the image. One,
BoingBoing, even [1]reprinted the 'non-commercial' clause, warning others
to stay away. But they've got their ads from Cheerios, HP and Mazda
running alongside. Does anyone care that we've gone to all this trouble
to create new, more flexible licenses? Does it even matter when very
smart people just flip the bird to the license? Is the only alternative
to sue? I wouldn't mind asking for $150k and settling for $1 for each
copy made, but that seems a bit crazy. I hate to type out DMCA notices
but their attitude is that only uncool people complain about this and I
should be happy about the publicity. Then they can be happy about not
sharing their ad revenue with artists or photographers. What can I do?"

SonicSpike links to what he calls "a transparent look at some
[0]statistics released by a small town's red-light camera program,"
writing "Specifically, in the last fiscal quarter, 7,213 incidents were
recorded, 2,673 incidents were rejected by the reviewing officer, and 662
incidents were not processed due to technical issues or lack of
information. All in all 3,878 citations were issued between April I —
June 30 in a town of 17,000 residents. Interestingly enough there are two
nearby cities claiming that individuals 'have [1]no presumption of
innocence' when accused by the red light cameras." Fines for
no-harm-no-foul rolling stops bug me, and remind me of Gary Lauder's
[2]suggestion to merge stop signs and yield signs.

Nintendo DS are illegal, finding [1]two vendors guilty of selling 'game
copiers.' The ruling by Justice Floyd is quoted as saying, 'The economic
effect on Nintendo of the trade in these devices is substantial as each
accused device can store and play copies of many Nintendo DS games [...]
The mere fact that the device can be used for a non-infringing purpose is
not a defence.' No word in the article as to what law in particular they
were found to have broken, nor of the penalty the vendors are facing, but
this looks like bad news for all kinds of hardware mod, on any platform,
that would enable homebrew users to bypass vendor locks." Nintendo won

findings in the NVIDIA/Rambus patent infringement lawsuit, and it's not
the sort of ruling Team Green would've preferred. The commission [1]found
NVIDIA to be in violation of three Rambus patents. The trade panel also
granted an injunction Rambus had requested, which theoretically prevents
NVIDIA and the various companies attached to the lawsuit (Asus, HP,
Palit, and MSI among others) from selling products that contain the
infringing IP. The commission's decision this week affirms a January
ruling that saw NVIDIA in violation of three Rambus patents while
dismissing two additional claims of infringement Rambus made."

crabel writes "In Java 1.6.0_21, the company field was changed from 'Sun
Microsystems, Inc' to 'Oracle.' Apparently not the best idea, because
[0]some applications [1]depend on that field to identify the virtual
machine. All Eclipse versions since 3.3 (released 2007) until and
including the recent Helios release (2010) have been reported to crash
with an OutOfMemoryError due to this change. This is particularly funny
since the update is deployed through automatic update and suddenly
applications cease to work."

An anonymous reader writes "Back in June ASCAP oddly [0]declared war on
free culture, specifically calling out Creative Commons, EFF and Public
Knowledge, making a number of false statements about all three. The war
of words [1]continued as the three groups responded politely, pointing
out the errors in the statement from ASCAP's Paul Williams. Larry Lessig
wrote a blog post where he [2]asked Williams to debate these topics,
saying that it might help if they could get away from making false
statements. Williams has now [3]publicly declined to debate saying that
it's not worth his time, and once again attacking these groups for trying
to 'silence' him. It's difficult to see how a request for a public
discussion and debate is an attempt to silence, but that's ASCAP's
position and they're sticking to it."
